BYTWEI'S COMMISSION TOS

All payment is due upfront, done in USD and will be done through Paypal Invoice. The use of Invoice is not debatable.

Payment is expected to be done within 48 hours

All commissions are for PERSONAL use only unless commercial rights are bought

The artist reserves the rights to post commissioned work in social media, unless the client has informed the artist to not post beforehand.

Clients are allowed to re-upload commission work to personal social media WITH credit to the artist.

At least one clear reference of commissioned character/subject is preferred.

DO NOT USE FOR AI GENERATORS OR NFTS

The artist is allowed to refuse a commission at any time without any further explanation

Disrespectful behaviour will not be tolerated and the commission will be cancelled if it occurs.

The terms outlined below may vary slightly depending on the commission type however if so, terms will be discussed and agreed upon before the start of the commission.

All payment is in USD

Payment is due in full upfront. However for personal commissions that cost over $100, payment options can be discussed.

Payment must be done within 48 hours after the commission type and terms are confirmed. The commission will not be started unless the payment is done and if the client has failed to pay within the 48 hours without notice or contact, the commission slot will be cancelled and given to another.

Payment is done through Paypal invoice. An invoice will be sent to the client upon agreement. Please understand that the use of invoices is not debatable.

A rush fee will be charged for tight deadlines (Check VI. Process & Workflow)

A design fee may be charged for clients with no reference images and depend on me drawing solely from a description and or moodboard, however this depends on commission type & complexity. (Check IV. Client obligations)

Additional fees will be charged for excessive or major revisions(Check VII. Revisions)

All additional fees stated above that may occur will be informed to the client before the start of a commission, in the case of additional fees regarding revisions, the artist will inform the client if any revisions at that moment may incur additional fees.

Once the commissioned artwork is approved, a refund is not permitted.

The client is able to cancel the commission at any time however the artist will only issue a refund equivalent to the amount of work not done. Completed or nearly completed commissions will receive a 0% refund.

The artist reserved the right to cancel and refund the money for commissions at any time.

If the artist cancels the commission due to inability to complete it at any stage, a full refund will be given. (Check VI. Workflow for more information)

Visual Reference Guidelines. Please provide at least one clear reference image of the character/subject. Additional information that may be important to correctly draw the character/subject is also very welcome. You may link to a gallery of your character’s commissioned artwork, but due to each artistic interpretation, the design may be inconsistent and may lead to inaccuracy. So in this case, please inform the artist of which artwork is most accurate to be used as reference.

Mood boards are welcome. This includes possible poses or clothing styles the client may want to see in the commission.

Please maintain professional conduct throughout the commission process.

Please respond in a timely fashion, in the case of inability to be contacted, please inform the artist beforehand.

Please understand that we may be operating in completely different time zones. This means that sometimes it may take the artist a while to respond, however the artist will always respond as soon as possible.

Estimated timeframe. While this is highly dependent on the type of commissions, in general, commissions will take roughly 1 to 3 weeks to finish. However, if for any reason I cannot complete a commission within 90 days of ordering, I will issue a full refund. In the case of any delays in completion of a commission, the artist will personally notify the customer.

The artist will send over a sketch to be approved before continuation of the commission, one complete revision will be allowed at this stage.

WIPs (Work in Progress) will be sent through the commission process,

Both the sketches and WIPs will be sent as low resolution and watermarked images.

Deadlines must be agreed upon prior to the start of commissions

The artist will always aim to complete commissions within a timely manner, but please understand that sometimes life may get in the way and cause a delay. However, the artist will always notify the client of any issues that may come up.

One major revision is allowed in the sketch phase.

5 minor revisions are allowed in the rendering stage.However, more revisions may be allowed by the artist on a case by case basis.

Additional or major revisions will incur additional prices, however the artist will inform the client of these charges before going through with said revisions.

The artist retains the rights over any commissioned works.

The artist reserves the right to post the commissioned work on my social media. In the case that the client does not want the commission to be uploaded. Please inform this before the start of the commission

The artist reserves the right to stream, record, and upload videos of the creation of the artwork.

Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.

The final product is strictly for PERSONAL use only, unless commercial rights are purchased.

Please credit and link back to the artist @bytwei when sharing or using the commissioned work.

For commercial use, the rights can be purchased for 300% the original price. However this price may differ depending on the commercial use and will be discussed beforehand.

Credit may still be required when using the work in any form commercially. However this depends on a case by case basis and will be discussed beforehand.

Print the work for personal use.

Crop and/or resize the image for use as an avatar, header or thumbnail that is not monetised (Youtube thumbnails are NOT allowed unless agreed upon before by the artist)

Use the artwork as reference for a study.

Post the artwork on social media, with credit to the artist clearly visible.

Claim the artwork as yours.

Remove watermarks or signatures.

Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.

Colour in sketches or lineart.

Use the commissioned piece in any technology related to NFTs, cryptocurrency, or AI.

Reproduce the work commercially without purchasing the rights from me.

Commissions will be always be done in 300 dpi and will be sent to the client in JPEG & PNG formats

The final sketch and final artwork will be sent to the client

For an additional $5, The PSD or CLIP file of your commission can be purchased
